Circuit Court Filings - License Remands
Some attempts to restore licenses require a trip to Circuit Court. Prior to January 1, 1992 Circuit Court was the only forum in which to restore a license. Changes in the drunk driving laws that became effective on January 1, 1992 put an end to this. Theretofore hardship appeals, the most common reason for license restorations, constituted the most common ground for such restorations. The new law at that time removed "hardship" as a ground for a Circuit Court appeal. Some grounds remained open including merit appeals and appeals made from adverse rulings from other licensing entities. Further changes in the drunk driving law ( MCLA 257.625 ) effective October 1, 1999 nearly finished off Circuit Court as a forum in which to restore a license. Left were three circumstances in which Circuit Court would have jurisdiction. They were a). implied consent first offense suspensions, b). denials based on failures of physical tests to drive and c). remands to D.A.A.D. ( Driver Assessment and Appeals Division ) and in some cases outright grants of licensure for mandatory additional suspensions which preceded the enactment of the above two ( 2 ) drunk driving law changes. As is evident from the foregoing there is still a limited jurisdiction which resides within the Circuit Court to restore licenses. To investigate whether your case falls into the aforementioned categories, to act on it if it does, to produce pleadings and to formulate arguments in such cases, you should have counsel.
